Die Firma Botach Tactical ist durchaus ein grosser Waffenlieferant und die Micki Maus Firma AEY, über welche die Waffengeschäfte der Albanischen Regierung, des CIA und für die Afghanische Regierung abgewickelt wurde, war eine Art Kinder Stube und Übungs Spielwiese der befreundeten Rabbiner Familien. Die Firma AEY, wo ein 19-jähriger Sohn als Geschäftsführer vor 3 Jahren eingesetzt wurde, hatte eine Lizenz für den Verkauf von Fahrrädern.

Defense contractor AEY was never certified as a disadvantaged business for the purposes of government contracting, Elizabeth Newell and Robert Brodsky reported in yesterday's edition of Government Executive:
"They are not an SDB," an official from the South Florida office said. "They are not 8(a) or anything like that. They are just a firm that is listed in [the Central Contractor Registry] for purposes of being able to secure contracts."

House sleuth Henry Waxman (D-CA) read the news today, oh boy. And he wants 22 year-old AEY President Efraim Diveroli, his 25 year-old VP (and masseur) David Packouz, and the company's general manager, also 25, to testify before Congress about how they managed to get a $300 million U.S. contract to supply (sometimes forty year-old) ammunition to the Afghan Army, among other contracts. Waxman also wants officials from the Department of Defense and Department of State to appear as well. He's set the date of April 17th.

The president of this multi million dollar company is 22 years old, Mr. Efraim Diveroli. The Vice President, whose qualification is as a masseuse, Mr. David Packouz, is 25 years old.

Efraim Diveroli has been charged with violating the Arms Export Control Act.A 22-year-old munitions dealer and others in his Miami Beach company were arrested on charges of selling prohibited Chinese weaponry to the U.S. government to supply allied forces in Afghanistan, according to law enforcement officials.
Efraim Diveroli, president of AEY Inc., and three other employees were arrested Thursday night and Friday morning -- accused of conspiring to misrepresent the types of munitions they sold to the U.S. Department of Defense as part of a $300 million Army weapons contract, officials said.

In 2004, AEY listed Efraim Diveroli, then 18, as an officer with a 1 percent ownership stake.
The younger Diveroli’s munitions experience appeared to be limited to a short-lived job in Los Angeles for Botach Tactical, a military and police supply company owned by his uncle, Bar-Kochba Botach.
As Efraim Diveroli arrived in Miami Beach, AEY was transforming itself by aggressively seeking security-related contracts.
It won a $126,000 award for ammunition for the Special Forces; AEY also provided ammunition or equipment in 2004 to the Department of Energy, the Environmental Protection Agency, the Transportation Security Administration and the State Department.
By 2005, when Diveroli became AEY’s president at age 19, the company was bidding across a spectrum of government agencies and providing paramilitary equipment — weapons, helmets, ballistic vests, bomb suits, batteries and chargers for X-ray machines — for American aid to Pakistan, Bolivia and elsewhere.
It was also providing supplies to the U.S. military in Iraq, where its business included a $5.7 million contract for rifles for Iraqi forces.
Two federal officials involved in contracting in Baghdad said AEY quickly developed a bad reputation. “They weren’t reliable, or if they did come through, they did after many excuses,” said one of them, who asked that his name be withheld because he was not authorized to speak with reporters.
AEY was awarded the contract in January 2007. Asked why it chose AEY, the Army Sustainment Command answered in writing: “AEY’s proposal represented the best value to the government.”
EASTERN ARSENALS
Both the Army and AEY have treated the sources of the ammunition the company purchases as confidential matters, declining to say how and where the company obtained it, the prices paid or the quantities delivered.
But records provided by an official concerned about the company’s performance, a whistle-blower in the Balkans and an arms-trafficking researchers in Europe, as well as interviews with several people who work in state arsenals in Europe, show that AEY shopped from stocks in the old Eastern bloc, including Albania, Bulgaria, the Czech Republic, Hungary, Kazakhstan, Montenegro, Romania and Slovakia.

DANGEROUS DEPOTS: The Growing Humanitarian Problem Posed by Ageing and Poorly Maintained Munitions Storage Sites Around the World
Some information in the historical timeline in this Fact Sheet was drawn from a list entitled “Major Ammunition Accidents – 1916 to 2008” compiled by Colonel George Zahaczewsky, U.S. Army (Retired). Colonel Zahaczewsky was formerly the Director of the U.S. Department of Defense’s Humanitarian Demining Research & Development Program. Information was also drawn from “Recent Explosive Events in Ammunition Storage Areas,” a report of 137 incidents released in June 2007 by the South Eastern and Eastern Europe Clearinghouse for the Control of Small Arms and Light Weapons (http://www.seesac.org).
On March 15, 2008, a series of massive and deadly explosions ripped through an Albanian government munitions depot in the village of Gërdec near Tirana, resulting in 24 deaths, injuries to over 300 more people, and catastrophic damage to hundreds of homes and other civilian structures within a 2.5 kilometer (1 1/2 miles) radius. Contributing factors to the initial explosion which triggered a cascade of further explosions involved old, unstable ammunition, improper storage, and unsafe handling. Sadly, this was not a unique incident.

They are but the latest in a series of incidents spanning many years and among the most recent manifestations of an international problem that has worsened since the end of the Cold War – government arms depots filled with ageing, unstable, poorly maintained, improperly stored, and weakly guarded munitions. March 15, Albania. A massive explosion at a munitions depot in Gërdec, northwest of the capital Tirana, killed some 24 people, injured over 300, destroyed over 400 homes, and resulted in the evacuation of over 4,000 nearby residents. The saga of United States military contractor AEY and its supply of substandard ammunition to Afghanistan keeps getting curiouser and curiouser, as Alice in Wonderland phrased it, after descending the rabbit hole. Or put another way, it is the news story that keeps on giving.
Since the New York Times first reported March 27 on the contract awarded on January 26, 2007, to Miami Beach, Florida-based AEY Inc, headed by then 21-year old president Efraim E Diveroli, with the US Army to provide US$298 million in various types of ammunition to the Afghan army and police forces, and the rabbit hole just keep getting deeper.

The contract required AEY to certify that it was providing "serviceable and safe ammunition". The army contract also banned supplying ammunition acquired "directly or indirectly from a communist Chinese military company".
But according to the Times the company provided ammunition that is more than 40 years old and in decomposing packaging. Much of the ammunition came from old communist bloc aging stockpiles, including those that the US State Department and North Atlantic Treaty Organization had determined to be unreliable and obsolete, and had spent millions of dollars to have destroyed.
The ammunition had not been tested for reliability under well-established military standards. The obsolete and defective cartridges were shipped in poorly packed cardboard boxes that split open on arrival in war zones. Other ammunition was in crates that suffered from extensive termite damage and "were no longer safe for transportation".
Documents uncovered by the Times revealed that AEY bought more than 100 million Chinese cartridges that had been stored for decades. Different lots or types of ammunition were mixed. In some cases, the ammunition was dirty, corroded or covered with a film. The repackaging operation was carried out by an AEY subcontractor at the Rinas Airport in Tirana, Albania.

Albania: Whistle-Blower Found Dead

A whistle-blower who uncovered evidence of public corruption and deceptive practices by a contractor in a Pentagon-sponsored arms deal was found dead on a mountain road on Friday. Last year, the whistle-blower, Kosta Trebicka, 48, provided The New York Times and American investigators with evidence that AEY Inc., an American company, had bought aging Chinese cartridges for Afghanistan’s army and police forces, repackaged them in unmarked boxes that obscured their origin and claimed the ammunition was from Albania. His accusations shook the Albanian government and the Pentagon. Mr. Trebicka had told reporters for The Times several times that he feared for his safety. He was found dead near his vehicle, and no cause of death was announced. Albanian investigators said an autopsy would be performed.

Albanian prosecutors close case on key witness's death

TIRANA, Albania -- Prosecutors in the town of Korca announced on Wednesday (October 15th) they have ended their investigation of the death of Kosta Trebicka, a key witness in a separate investigation of the illegal ammunition trade. Local experts and US investigator Kevin Teter concluded that Trebicka died in a car accident. He was found dead on September 12th on a mountainous road in eastern Albania. Last year, he told Albanian and US investigators that the US company AEY Inc. had bought old Chinese ammunition from Albania for resale to the Afghan army and police. He said the firm was repackaging the ammunition in Albania to hide its origin.
In other news, police in the town of Kapshtica arrested eight Afghan nationals trying to illegally cross the border from Greece to Albania early Wednesday. Miami Beach arms dealer gets millions back

A Miami Beach munitions dealer accused of defrauding the federal government is $4.2 million richer.
Actually, the money already belonged to 23-year-old Efraim Diveroli. But the government froze it after Diveroli, his business, AEY Inc., and three co-workers were indicted last summer on charges of selling banned Chinese-made machine-gun rounds to the U.S. Army to supply allied forces in Afghanistan.
Prosecutors recently agreed to unfreeze the money -- as well as return Diveroli's 2007 Mercedes-Benz S550 -- after realizing the funds indeed came from some of the company's $300 million in weapons sales to the U.S. military, but none involving the Chinese munitions.
Getting back the millions, however, is a small victory. Diveroli, whose grandfather once described him as a weapons ''genius,'' still faces charges of conspiring to sell the military $10.3 million of prohibited Chinese munitions that he and his employees tried to disguise as being made in Albania.
Prosecutors will seek to recover the $10.3 million if they win convictions of Diveroli and the others at trial in September.
The case centers on a Chinese-made weapons embargo passed by Congress in 1989 in response to the massacre of dissidents in Tiananmen Square. Despite normalized trade relations with China, it has remained in effect.
Now Diveroli's lawyers are pushing to have the indictment dismissed, saying he didn't violate the U.S. embargo because the Albanians acquired the Chinese munitions during the Cold War -- some 15 to 27 years before the embargo took effect. Diveroli didn't buy them from Albania until late 2007.

The 85-count indictment charges Diveroli, his company and employees David Packouz, 26, of Miami, Alexander Podrizki, 26, of Miami, and Ralph Merrill, 65, of Salt Lake City with defrauding the United States and other procurement offenses. All are free on bond awaiting trial.
The improbable story of Diveroli's activities broke in March 2008, when The New York Times reported that he had allegedly misled the Army by saying most of the machine-gun cartridges he sold to the U.S. Army were from former Soviet-bloc countries -- not China. The munitions were for Afghan forces fighting the Taliban and al Qaeda insurgents.
The Pentagon suspended AEY's contract in March and terminated it in May, concluding, ``AEY violated the terms of the contract by delivering ammunition from a prohibited source.''

Banned Chinese ammunition allegedly sold to supply Afghanistan
MIAMI - U.S. Immigration and Customs Enforcement (ICE) lead the joint investigation into a 22-year-old Miami Beach munitions supplier who was indicted earlier today for defrauding the government in a contract involving supplying ammunition to Afghanistan. The investigation that led to these indictments was led by ICE's Counter Proliferation Investigations (CPI) Unit.
AEY, Inc. (AEY), its president, Efraim Diveroli, and his two former employees, David Packouz and Alexander Podrizki, both 26 and Miami residents, and business associate, Ralph Merrill, 65, of Salt Lake City, Utah, were indicted by a federal grand jury in Miami on wide-ranging fraud charges in connection with their provision of ammunition to Afghanistan. The defendants are alleged to have conspired to misrepresent the types of ammunition they sold to the U.S. Department of Defense as part of a $298 million Army contract.
More specifically, count 1 of the indictment charges all defendants with conspiracy to defraud the U.S. by making false representations to the government and by conspiring to commit procurement fraud, in violation of Title 18, United States Code, Section 371 (Count 1). Counts 2 through 36 charge defendants AEY and Efraim Diveroli with making false statements to the U.S. Army regarding the country of origin of the ammunition, in violation of Title 18, United States Code, Section 1001. Defendant David Packouz was a Director and Vice President of AEY. Defendant Alexander Podrizki was an agent of AEY, stationed in Tirana, Albania. Defendant Ralph Merrill was a business associate of Diveroli, who provided financial and managerial assistance to AEY.

TIRANË- Mihal Delijorgji, i akuzuari kryesor si shkaktari i tragjedisë së Gërdecit ka ende firma të shpërndara në Shqipëri, të cilat vazhdojnë që të punojnë.
Kompania është "Trans Digging Construction" dhe Delijorgji është aksioner së bashku me vajzën e Fahri Balliut, një prej njerëzve të afërt dhe "këshilltarët" e kryeministrit Berisha. Aksioner tjetër është edhe vëllai i Mihal Delijorgjit, Kristo.
Firma është themeluar në vitin 2006 por vetëm pak ditë më parë dy prej aksionerëve kanë lënë pjesën e tyre duke ia dhuruar aksionerëve të tjerë. Kjo firmë vazhdon që të jetë edhe aktive dhe të kryejë punime. Edhe pse prokuroria ka pohuar se ka sekuestruar të gjitha pronat e Mihal Delijorgjit, në rastin konkret kjo gjë nuk ka ndodhur.

Efraim Diveroli, president i firmës "AEY", thotë se nuk ka trafikuar fishekë. I riu, trashëgimtar i një biznesi familjar të lindur shumë vite para se të vinte ai në jetë e të bëhej emër i njohur edhe në Shqipërinë e largët, nuk e pranon as akuzën e trafikimit dhe pret nisjen e gjyqit në Florida, shtatorin e ardhshëm.

1,4 Millionen € Import Zoll Gebühren blieb Delijorgji in 2004 schuldig und der Zoll gab die Sache dann zu Gericht in Durres.
Dort wurde dann das Verfahren niedergeschlagen, gegen die übliche Bestechungs Gebühr an die Richter. Nun wird der Gerichts Beschluß für ungültig erklärt und nun erneut diese Geldsumme eingetrieben.
